Eligibility: You must be at least 18 years old to create an account and use our platform. By registering, you represent that you are of legal age and able to enter into a binding contract.

Account Creation: To list or advertise items, you need to create an account. You agree to provide truthful, accurate, and current information during registration and to update it if it changes. This includes your name (or business name), contact details, and any other required details. Using false identities or someone else's information is prohibited.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Keep your password secure and do not share it. You are liable for all activities conducted under your account. If you suspect any unauthorized use of your account or a security breach, notify us immediately so we can help secure your account.

One Account Rule: In general, we recommend one account per individual or entity. If you need multiple accounts (for example, separate accounts for a personal profile and a dealership), ensure you have permission and manage each account according to these Terms.

Profile and User Content: You may have a profile page or username on the Site. Do not impersonate any other person or company, and do not choose a username that is offensive or violates someone's rights. We reserve the right to remove or reclaim usernames if we deem appropriate (such as if a trademark owner complains about a username closely related to their brand).

Listing Platform Only: dronesales.com.au provides a platform for sellers (private individuals or dealerships) to list drones, drone accessories, and related equipment for sale, and for interested buyers to view those listings. We are not a traditional retailer or auctioneer; we do not own the listed items and we do not broker sales. Our role is to facilitate advertising and user connections.

No Sales Facilitation: Any actual sale or purchase transaction is strictly between the buyer and the seller outside of our platform. We do not handle payment for the item, shipping, or transfer of ownership of goods. Buyers will typically contact sellers directly (through contact information or messaging as enabled on the Site) and arrange the sale offline (e.g., in person or via their own payment methods).

No Agency: Using our site does not create any agency, partnership, joint venture, or employment relationship between any users and dronesales.com.au. We are not the agent of any seller or buyer. We do not guarantee that any buyer or seller will complete a transaction, and we are not responsible for any obligations of either party related to a sale.

Listings: Sellers create listings with details about the item (e.g., drone model, condition, price, location, photos, and any terms of sale). It is the seller's responsibility to ensure the listing is accurate, lawful, and not misleading. We do not pre-approve or endorse listings, though we may moderate content for compliance with these Terms.

Communication: Our platform may allow buyers and sellers to communicate (for example, through an inquiry form or messaging system). You agree to use such communication channels only for genuine inquiries or negotiations related to listed items. We do not publicly reveal your email or phone in the listing without your consent; initial contact may be facilitated through the platform to protect privacy.

Listing Fees: Listing an item on dronesales.com.au may require payment of a listing fee. The applicable fees (and the duration or terms of the listing) are disclosed on our Site or during the listing creation process. For example, we might charge a fixed fee per listing or offer packages for dealerships - the exact pricing and package details will be provided to you before you finalize a listing. By submitting a listing, you agree to pay the specified fees.

Payment Process: All listing fees are payable in Australian Dollars (AUD) and may be subject to GST if applicable. Payments are processed securely via our third-party payment processor, Stripe. You must provide a valid payment method (such as a credit/debit card) at the time of listing. The payment will be processed immediately when you submit the listing for publication. We use Stripe to handle payments and do not store your card details (they are sent directly to Stripe).

Billing and Receipts: After payment, you will receive a confirmation (on-screen and/or via email) that your listing is live, along with a receipt for the fee paid. If your payment fails or is declined, the listing will not be posted. You may need to update your payment information or use a different method to complete the purchase of the listing.

No Sale Commission: We do not take any commission or percentage on the sale of the actual item because the transaction is done outside our platform. Our only charges are the upfront listing fees (or subscription fees, if you opt for a dealer package) for using our advertising service.

Refund Policy: Listing fees are generally non-refundable once the listing is live. This is because the service (advertising your item) is considered delivered when the listing is posted. However, if a listing does not go live due to an error on our part, or if we remove a listing without cause shortly after posting, we may, at our discretion, refund the fee or offer credit for a future listing. If your listing is removed or your account is terminated for violating these Terms or due to illegal content, you will not be entitled to a refund of fees paid.

Changes to Fees: We reserve the right to change our listing fees or introduce new fees in the future. Fee changes will not affect listings already paid for, but will apply to new listings or renewals. We will notify users of fee changes by updating the Site information and, if significant, by email or notice on your account dashboard. Continued use of the platform or posting new listings after a fee change constitutes acceptance of the new fees.

Lawful Purpose Only: You must use the platform for lawful purposes only. Do not list or sell any prohibited or illegal items. Items you must NOT list include (but are not limited to) those that are:

Accuracy and Legitimacy: All information in your listings must be truthful and not misleading. Do not misrepresent the item's condition, specifications, history, or availability. If you're a seller, you warrant that you have the right to sell each item and that the item is as described. You should also ensure that selling the item complies with all applicable laws (for instance, Australian regulations on drone equipment, export controls if shipping overseas, etc.). You are responsible for any required permits or approvals related to the item.

No Fraudulent Activity: You agree not to engage in fraud or deceptive practices. This includes schemes like posting listings for items you do not intend to deliver, using false contact information, or using the site to gather personal data under false pretenses. Any attempt to scam other users can result in immediate suspension.

No Harassment or Abuse: Treat other users with respect. You must not harass, threaten, or abuse anyone on our platform. This applies to listing content (no hate speech or personal attacks) and any communications with buyers or sellers (no spamming, trolling, or bullying). Harassment or threatening messages are strictly prohibited.

No Spamming or Unsolicited Advertising: Do not use the platform to advertise unrelated products or services. You should only contact users in direct relation to a genuine interest in their drone listings. Mass unsolicited communications, repetitive posting of the same item, or posting links to external websites unrelated to a sale are not allowed.

Intellectual Property: Only post content (including text and photos) that you have the right to use. Do not upload images or descriptions taken from others without permission, and do not infringe trademarks or copyrights. You are responsible for the content you add to the site, and you assure us it doesn't violate any third-party rights.

System Integrity: You agree not to interfere with the operation of dronesales.com.au. This means you will not attempt to hack, inject malicious code, disrupt service, or bypass any security measures. Also, do not use automated scripts or scraping tools to collect information from the site without our prior permission.

User Accounts: You may not share your account with others or sell/transfer your account. Additionally, you may not create multiple accounts to bypass restrictions or avoid fees. If you are suspended or banned, you must not create a new account without our consent.

Compliance with Additional Policies: Follow any other rules we publish on the Site (for example, if we publish a list of specifically prohibited items or content guidelines, those are incorporated into these Terms). For dealers or high-volume sellers, additional terms might apply (we will provide those during sign-up if relevant).

Enforcement: We reserve the right to remove any listing or content that violates the above rules or any part of these Terms, or that we consider inappropriate for any reason. We may do so without prior notice. We also reserve the right to suspend or terminate your account if you breach these provisions (see Section 8 on Termination). We are not responsible for any loss you may incur if we remove your content or terminate access due to your violation of the rules.

Your Content: When you create listings or otherwise submit content on dronesales.com.au (for example, text in descriptions, photos of your items, profile info, or reviews/feedback), you retain ownership of your original content. However, by uploading or posting this content, you grant us a license to use it. Specifically, you give dronesales.com.au a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (e.g., resize images), display, and distribute your content in connection with operating and promoting the site. This license lasts for as long as your content is protected by intellectual property rights and is necessary for us to provide our services. For example, we may display your photos on our homepage as part of a featured listings carousel, or use a screenshot of your listing in a social media ad promoting our marketplace.

Your Warranties for Content: You promise that you have all necessary rights to post the content you provide. This means (a) you took the photos or have permission from the photographer, (b) any text you posted is your own or you have rights to it, and (c) your content does not infringe any third-party's intellectual property or privacy rights. If your content includes personal data of others, you should have their consent. You also promise that your content is not defamatory or illegal.

Our Intellectual Property: The dronesales.com.au website, branding, and all content we create (like our logos, design, compilations of listings, and text on the site) are protected by intellectual property laws. We (or our licensors) retain all rights in our trademarks, logos, and site materials. You are not allowed to use our name, logo, or content without permission. For example, you can't copy our database of listings or use our trademarks in your own marketing without a license from us.

Limited Use: We grant you a limited, revocable license to use the Site for its intended purpose (buying/selling drones) in accordance with these Terms. You must not reproduce, reverse-engineer, or commercially exploit any part of the Site beyond what is allowed by these Terms and normal use of the marketplace.

Feedback: If you provide us with feedback or suggestions on how to improve our service, we may use those ideas without obligation to you. (This doesn't affect your rights in the content of your listings, but rather refers to ideas you volunteer to us about the platform itself.)

No Guarantee of Sale or Quality: We do not guarantee that your item will sell, or that you will find a drone that meets your expectations. We simply provide the marketplace. We do not control the content, condition, legality, or quality of the items that users list. The descriptions and photos are provided by sellers, not by us. We do not inspect items, and we cannot guarantee that any item will be safe, fit for a particular purpose, or match its description. That is the responsibility of the seller.

User Identity and Conduct: We do not thoroughly verify the identity or trustworthiness of each user (though we may do basic checks or have verification for dealers). Use caution and common sense when dealing with others online. We do not perform background checks or endorsements of users or their listings. Any opinions, advice, statements, or information given by users in listings or communications are those of the user, not of dronesales.com.au.

Transactions Are Between Users: Any agreements for sale are made directly between buyer and seller. We are not a party to those agreements and cannot enforce them for you. We do not handle the exchange of money or goods (aside from listing fees). As such, we will not be responsible if a buyer or seller fails to follow through with a transaction. For example, if a buyer does not pay or a seller does not deliver an item, that is outside our control and we are not liable. However, we encourage users to report any fraud or serious issues to us, and we may suspend or ban users who violate our rules or engage in misconduct.

No Warranty on Service Availability: We strive to keep the Site available and running smoothly, but we do not guarantee uninterrupted or error-free service. Downtime, bugs, or technical issues may occur. We provide the site "as is" and "as available". To the extent allowed by law, we disclaim any warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For example, we don't warrant that the site will be available 24/7 or that it will meet your specific needs.

Third-Party Links or Ads: The site might contain links to third-party websites or display third-party advertisements (for example, a banner ad or a link to a drone parts supplier). We are not responsible for the content or practices of those external sites. Clicking on external links is at your own risk, and you should read the terms and privacy policies of any third-party sites you visit.

Release: Because we are not involved in user-to-user dealings, if you have a dispute with one or more users (e.g., a dispute between a buyer and a seller regarding an item's condition), you release dronesales.com.au (and our owners, employees, and agents) from all claims, demands, and damages arising out of or connected with such disputes. This release does not waive any rights you may have under Australian Consumer Law against the other party; it simply clarifies that dronesales.com.au is not responsible for resolving these issues.

No Liability for Certain Losses: dronesales.com.au is not liable for any loss or damage related to your use of the platform, lost profits, loss of data, or loss of business opportunities. We are also not liable for the conduct or content of other users, or any transactions you enter into with others through our site.

Cap on Liability: If, despite the above, we are found to be liable to you for any reason (whether for breach of these Terms, negligence, or otherwise), our total cumulative liability will be limited to the greater of (a) the total fees you have paid to us in the past six (6) months, or (b) AUD $100. We find this fair because our fees are low and we are just providing a listing service.

Australian Consumer Law: We acknowledge that you may have certain rights under the Australian Consumer Law and other statutes that cannot be excluded (for example, certain guarantees as to the provision of services). Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you have under law which cannot be lawfully excluded or limited. To the extent we are permitted to limit our liability for breach of such rights, we will do so - for example, by offering to resupply the services or pay for the cost of resupply, at our choice, for any failure to meet a statutory guarantee.

Indirect Damages: In no event will we be liable for any indirect, incidental, special, or consequential losses or damages arising out of your use of (or inability to use) our platform. This includes any loss of profit, interruption of business, or loss of data, even if we have been advised of the possibility of such damages.

No Liability for Data Loss: You are responsible for keeping backup copies of any content or information you post on our site (such as your listing details or photos). We are not liable for any loss or damage to your content. Although we take measures to protect data, we cannot guarantee that content you post will never be lost or corrupted.

By Us (Suspension/Termination): We may suspend, restrict, or terminate your account and access to the platform at our discretion if we believe you have violated these Terms, engaged in fraudulent or illegal activities, or posed a risk to our community or operations. We also reserve the right to suspend or remove specific listings that violate our guidelines or for any operational reason. In most cases, we will attempt to notify you of the issue and give you a chance to resolve it, but in serious or repeat cases we may deactivate your account immediately without notice. Suspension or termination for cause (e.g., breach of Terms) will not entitle you to any refund of fees.

By You: You may stop using our service at any time. If you wish to permanently delete your account, you can do so through the account settings if available, or by contacting us to request account deletion. Once your account is closed, you will no longer have access to it, and your profile and any active listings will be taken down. However, these Terms (and any earlier version in effect during your usage) will still apply to any disputes or issues arising from your use of the platform.

Effect of Termination: If your account is terminated (by you or us), you remain responsible for any obligations incurred before termination. Any provisions of these Terms which by their nature should survive termination (such as indemnities, limitation of liability, and governing law) will continue to apply. We are not liable to you or any third party for account termination or content removal, and you have no claim against us for any losses (for example, if termination causes you to lose prospective sales or if you had remaining time on a listing - except we may at our discretion refund fees for unused listing time if you did nothing wrong and we terminated for convenience).

Appeal: If you believe we have suspended or terminated your account in error, you may contact us to request a review. We will consider your request in good faith but our decision thereafter will be final. We are not obligated to restore accounts or listings that were removed due to violations.

Governing Law: These Terms are governed by the laws of Australia. If you are using the platform as a business, then the laws of the State of Queensland, Australia govern these Terms. All users agree that any disputes arising under these Terms or related to the platform will be subject to the non-exclusive jurisdiction of the courts of Queensland. This means you can bring a claim in Queensland courts, and we can enforce obligations against you there, but we both can also seek interim relief in other jurisdictions if necessary.

Australian Consumer Law: Nothing in these Terms is intended to limit your rights under the Australian Consumer Law or other applicable Australian legislation. If any provision of these Terms is found to be invalid under those laws, that provision will be severed or interpreted to best meet the intent, and the rest of the Terms will remain enforceable.

No Waiver: If we do not enforce a provision of these Terms, that does not mean we give up the right to enforce it later. For example, if you breach a section of these Terms and we don't immediately act, we can still take action later for that breach or similar future breaches.

Severability: If any part of these Terms is held to be invalid or unenforceable, that portion will be construed in a manner consistent with applicable law to reflect, as closely as possible, the original intent, and the remaining portions will remain in full force and effect.

Entire Agreement: These Terms, along with our Privacy Policy and any other policies or guidelines we provide, form the entire agreement between you and dronesales.com.au regarding your use of the platform. They replace any prior agreements or understandings, whether written or oral, relating to the same subject matter.

Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our written consent. We may transfer our rights and obligations (for example, if our business is sold or transferred to another company), but if we do so, we will ensure that your rights under these Terms are not reduced.
